These Terms & Conditions govern your use of the WithU website and your WithU creator membership.
By purchasing a WithU membership, you agree to these Terms & Conditions. If you do not agree to them, you should not purchase or use a WithU membership.
1. About WithU
WithU is a creator membership network connecting creators with brands and opportunities across Lifestyle, Fashion, Beauty and Travel.
Your WithU membership may provide access to:
- Brand campaign opportunities
- Gifting and product opportunities
- UGC opportunities
- Affiliate opportunities
- Travel and experience opportunities
- A creator profile
- Creator resources, templates and guidance
- Other opportunities or services that WithU may introduce from time to time
Membership provides access to the WithU network and available opportunities. It does not guarantee that you will be selected for campaigns, receive products or experiences, earn money, or receive any particular number or type of opportunities.
2. Eligibility
You must be at least 18 years old to purchase or hold a WithU membership.
There is no minimum follower requirement to join WithU. However, you must have at least one active social media account that is relevant to your creator profile and provide accurate information about yourself and your content.
You are responsible for ensuring that the information you provide to WithU remains accurate and up to date.
We reserve the right to decline an application or membership where we reasonably believe that the applicant does not meet our eligibility requirements or where acceptance would be inappropriate for operational, legal, safety or other legitimate reasons.
3. Membership & Payment
WithU membership is provided on a recurring monthly subscription basis at the price displayed at the time you subscribe.
Unless otherwise stated, the membership fee is £14.99 per month.
Your membership has an initial minimum commitment of three months. This means that, subject to any statutory cancellation rights you may have, you agree to pay the applicable membership fee for the initial three-month period.
After the initial three-month period, your membership will continue on a rolling monthly basis and renew automatically until cancelled.
The applicable membership price, billing frequency and initial minimum commitment will be clearly presented before you complete your purchase.
Your payment details may be securely stored by our payment provider for the purpose of processing recurring payments. WithU does not normally have access to your full payment card details.
If a payment is unsuccessful, we may retry the payment and may temporarily suspend access to your membership until the outstanding amount has been paid.
4. Campaigns and Opportunities
WithU may introduce you to brands or present you with campaigns and other opportunities.
Brands are responsible for making the final decision as to which creators they wish to work with. Selection may depend on factors including your content, niche, audience, engagement, location, availability, suitability and the requirements of the relevant brand.
We do not guarantee that you will be selected for any particular campaign or opportunity.
Individual campaigns may have additional terms and requirements covering matters such as:
- Deliverables
- Content requirements
- Deadlines
- Payment
- Product or experience arrangements
- Content usage and licensing
- Exclusivity
- Advertising disclosures
- Other campaign-specific requirements
You will be given the relevant requirements before accepting a campaign. By accepting a campaign, you agree to comply with those requirements.
Where campaign-specific terms conflict with these Terms & Conditions, the campaign-specific terms will apply to that particular campaign to the extent of the conflict.
5. Payments & Commission
Where an opportunity is paid, the applicable payment amount and payment terms will be communicated before you accept the opportunity.
WithU currently charges 0% commission on campaign, UGC and affiliate earnings.
Your WithU membership fee is separate from any income you may receive from campaigns or other opportunities.
Third-party brands, affiliate networks and platforms may have their own payment terms, commission structures, eligibility requirements and conditions.
WithU does not guarantee that you will receive any particular level of income.
6. Gifting & UGC
Gifting opportunities may involve receiving products, services, experiences or other benefits in return for agreed content or other deliverables.
UGC opportunities may involve creating content for a brand to use on its own marketing channels or advertising and may be paid or unpaid depending on the opportunity.
The specific requirements, deliverables and usage rights for each opportunity will be provided separately.
7. Affiliate Opportunities
Affiliate opportunities may be provided by third-party brands, affiliate networks or platforms.
These opportunities may be subject to separate terms, commission rates, eligibility requirements, tracking arrangements and payment conditions.
WithU does not guarantee approval for any affiliate programme, sales, clicks, commissions or other earnings.
8. Your Responsibilities
You agree to:
- Provide accurate and up-to-date information.
- Complete accepted campaigns and opportunities within the agreed deadlines.
- Follow all applicable campaign requirements.
- Communicate professionally with WithU and brands.
- Comply with applicable laws, regulations and platform rules.
- Properly identify advertising, gifted content, affiliate content and other commercial content where required.
- Keep confidential information received through WithU or a brand confidential.
- Ensure that content you provide is original or that you have the necessary rights and permissions to use it.
- Not use WithU to engage in fraudulent, misleading, abusive, unlawful or inappropriate activity.
You are responsible for your own tax affairs and for declaring any income or benefits received through WithU or opportunities introduced through WithU where required by law.
9. Creator Profile & Content
When you become a WithU member, we may create and maintain a creator profile using information you provide to us.
Your profile may include information such as your creator name, social media accounts, niche, follower numbers, engagement information, location, portfolio, previous collaborations and other information relevant to matching you with opportunities.
You authorise WithU to use your creator name, social media handles, profile information and content you provide to WithU for the purposes of operating, promoting and marketing WithU and facilitating relevant opportunities.
You retain ownership of content you create unless different ownership or licensing arrangements are agreed for a particular campaign.
Campaign-specific terms may provide a brand with rights to use content you create, including rights relating to reposting, advertising, paid media, editing or other commercial uses. Any such rights should be reviewed before accepting the relevant campaign.
You are responsible for ensuring that content you provide does not infringe another person's intellectual property, privacy or other rights.
10. Advertising and Disclosure
You are responsible for complying with applicable advertising and consumer protection requirements when creating or publishing commercial content.
This may include requirements relating to paid partnerships, gifted products, affiliate links, discount codes and other commercial relationships.
You must follow any reasonable disclosure instructions provided by WithU or the relevant brand and comply with applicable rules issued by bodies such as the Advertising Standards Authority and applicable social media platforms.
11. Confidentiality
You may receive confidential information about brands, campaigns, products, launches, pricing, strategies or other matters through WithU.
You agree not to disclose or misuse confidential information except where disclosure is required by law or authorised by WithU or the relevant brand.
This obligation continues after your WithU membership ends in relation to information that remains confidential.
12. Cancellation and Refunds
Your rights to cancel your membership and any entitlement to a refund are set out in our Refund Policy and Cancellation Policy.
Nothing in these Terms & Conditions limits or excludes any statutory rights you have under applicable UK law.
Cancelling your membership does not automatically cancel a campaign or opportunity you have already accepted. Unless WithU or the relevant brand confirms otherwise, you remain responsible for fulfilling accepted campaign requirements.
13. Suspension and Termination
We may suspend or terminate your membership where reasonably necessary, including where:
- You seriously or repeatedly breach these Terms & Conditions.
- You provide false or misleading information.
- You engage in fraudulent or unlawful activity.
- You fail to make required payments.
- You repeatedly accept opportunities and fail to complete them.
- Your conduct creates a significant risk to WithU, another creator, a brand or another person.
Where appropriate, we will take reasonable steps to notify you and explain the reason for suspension or termination.
Termination does not affect rights or obligations that arose before termination.
Where termination occurs because of a breach by you, this does not automatically entitle you to a refund of membership fees already paid.
Nothing in this section affects any statutory rights you may have.
14. Third-Party Services
WithU may provide links to, or facilitate access to, third-party brands, websites, affiliate programmes, platforms and other services.
Third-party services may have their own terms, privacy policies, eligibility requirements and conditions.
We are not responsible for the availability, performance, content, policies or actions of third-party services that are outside our reasonable control.
15. Availability of WithU
We will take reasonable steps to keep the WithU website and membership services available, but we do not guarantee that they will always be available, uninterrupted or error-free.
We may temporarily suspend or modify services where reasonably necessary for maintenance, security, technical issues, legal requirements or other operational reasons.
16. Liability
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
Subject to the above, and to the extent permitted by law, WithU will not be responsible for indirect or consequential loss, loss of income, loss of business, loss of opportunity, loss of followers, loss of engagement or loss arising from your relationship with a third-party brand or service.
To the extent permitted by law, our total liability arising directly from your WithU membership will not exceed the total membership fees you paid to WithU during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms affects your statutory consumer rights.
17. Changes to These Terms
We may update these Terms & Conditions where reasonably necessary to reflect changes to our services, business operations, legal requirements or other relevant circumstances.
Where a change is material and affects your rights or obligations, we will take reasonable steps to notify you where appropriate.
The latest version will always be published on the WithU website with the date it was last updated.
18. Privacy
We process personal information in accordance with our Privacy Policy.
As part of providing the WithU service, relevant information from your creator profile may be shared with brands and campaign partners where reasonably necessary to facilitate opportunities.
19. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer, you will also retain any mandatory rights and protections available to you under the laws that apply to your circumstances.
